This SabiWay Privacy Policy (the "Privacy Policy") covers both the Website and mobile application operated and owned by SabiWay LTD. ("SabiWay" "we," "us" or "our") as listed below as well as to the Services (as defined below). DEFINITIONS OF TERMS

For purposes of this Privacy Policy:

  • "Services" means all services provided by SabiWay, including but not limited to the website located at www.sabiway.com, our mobile applications available on iOS and Android platforms, and all features, tools, and functionality that enable Customers to connect with Service Professionals for various service categories including but not limited to barbering, cleaning, electrical work, plumbing, painting, and handyman services.
  • "Platform" refers collectively to the SabiWay website, mobile applications, and all associated services.
  • "Personal Information" or "Personal Data" means any information relating to an identified or identifiable individual as defined by applicable data protection laws including the UK GDPR, EU GDPR, and Nigeria Data Protection Regulation (NDPR).

INFORMATION COLLECTED

We collect information from three different types of users:

  • "Customers" — refers to users who use our sites, services and also have other forms of interactions with the sites.
  • "Professionals" — refers to Service Professionals who have been approved by us or are seeking approval from us to deliver services to Customers.
  • "Visitors" — refers to people who visit our websites but do not register for services, while they may still access content.

HOW WE COLLECT INFORMATION

We collect information that you provide directly to us and when you interact with the platform. This interaction covers but not limited to account registration, signing up for newsletters; participation in survey & polls; filling out any forms; requesting and responding to a quote. Some of the information we collect include:

  • Contact information, including your phone number, email address, physical address, and first and last name, are required to create an account.
  • Billing information includes your zip code, security code, expiration date, and credit or debit card number.
  • Identity information includes your date of birth, your National Insurance number (UK), social security number (US), tax ID number, VAT ID number, or social insurance number, as well as a picture of your ID document, such as your driver's license, passport, or local ID, depending on your location.
  • Promotional information includes the data you enter when taking part in surveys, competitions, or other similar activities.
  • Device information, which includes information on the device or browser type, your device's operating system, internet service provider, regional and language preferences, and device identifiers like IP address and AD ID.
  • Location data includes information about a city, postal code level, latitude, and longitude, as well as information obtained from an IP address.
  • Service Use data, such as the time of day you browse, the emails and ads you see and may interact with, and your actions on the Platform's features and webpages.
  • Background Check Information, such as the findings of your background check, which may reveal any criminal infractions.

Additional Information for Service Professionals

If you are a service professional, we may also collect information like:

  • Company name and address
  • Categories that apply to your business practices
  • Any license information you provide
  • Criminal background checks
  • At your discretion, a business profile and a link to your company's website
  • Any other information required on the registration form

HOW WE USE YOUR INFORMATION

We use your information to:

  • Make it possible for you to utilize the services offered by the Platform, including registering you for our services and confirming your identity and permission to use them
  • Provide customer service and to answer your questions
  • Get in touch with you regarding how you're using the Platform
  • Link you with other people so you can complete a task or a job
  • Handle billing and prevent fraud in order to guarantee a secure setting that makes financial transactions easier
  • Perform criminal background checks and identification checks as allowed by relevant laws
  • Guarantee our users' offline and online safety
  • Preserve the Platform's integrity

HOW WE DISCLOSE YOUR INFORMATION

SabiWay does not share, sell, rent, or trade your personal information with other parties except as stated in this Privacy Policy. We provide your Personal Information to third parties for the following purposes:

  • Subsidiaries and Affiliates: We may provide your information to select third parties who perform services on our behalf. These third parties provide a variety of services to us including without limitation billing, sales, marketing, advertising, market research, fulfillment, data storage, analysis and processing, identity verification, fraud and safety protection and legal services.
  • Legal Requirements: We may disclose your information when required by law or when we believe in good faith in order to: (a) comply with subpoenas, court orders, or other legal process we receive; (b) establish or exercise our legal rights, including enforcing and administering agreements with Users; or (c) defend SabiWay against legal claims. Please be aware that even if you contest the disclosure request, we might still be obligated by law to provide your information.
  • Service Professionals: In certain situations, we could give consumers project requests to choose service professionals in order to make it easier for them to locate a service professional who can offer a service they have indicated interest in.
  • Promotions or Offers: We may give your personal information to a partner in order to fulfill your request for a product or service when you willingly participate in a prize draw, competition, promotion, or offering.
  • Advertising: Your personal information may be disclosed to such parties for marketing purposes.
  • Business Transfers: As our business continue to evolve, we may sell, buy, merge, or partner with other companies or businesses, or sell some or all of our assets. Your information may be shared and/or transferred as part of such anticipated or actual transactions, or if SabiWay's control changes.

PAYMENT PROCESSING

SabiWay uses third-party payment processors to handle all financial transactions on the Platform. We do not directly store your complete credit card, debit card, or bank account information on our servers.

Payment Processors We Use:

We use PCI-DSS compliant payment processors like Flutterwave, Stripe, Paystack and many more to securely process payments.

Information Shared with Payment Processors:

When you make a payment through the Platform, the following information is shared with our payment processors:

  • Billing name and address
  • Payment card information (card number, expiration date, security code)
  • Transaction amount and details
  • Email address

What We Store:

For your convenience and security, we only store:

  • The last four digits of your payment card
  • Card type (Visa, Mastercard, etc.)
  • Card expiration date
  • Billing zip code

RETENTION OF PERSONAL INFORMATION

For as long as it takes to deliver our goods or services and achieve the goals outlined in this privacy statement, we will keep your personal information. We will either remove your information from our systems or deidentify it so that we cannot use it to reidentify you when we no longer need to use it and there is no need for us to retain it in order to fulfill our legal duties or to the extent allowed by relevant laws.

Specific Retention Periods:

  • Account Information:
    • Active accounts: Retained for the duration of your account plus 6 months after account closure
    • Inactive accounts: Accounts inactive for 2 years may be deleted after notification
  • Transaction Records:
    • Payment and billing information: Retained for 7 years for accounting and tax purposes
    • Service history: Retained for 3 years after last transaction
  • Background Checks (Service Professionals):
    • Background check results: Retained for 3 years or as required by applicable law
    • Identity verification documents: Retained for 5 years after account closure

    • In-platform messages between Customers and Professionals: Retained for 1 year after service completion
    • Marketing communications records: Retained until you opt out, then deleted within 30 days
  • Usage Data and Analytics:

  • Reviews and Ratings: Retained indefinitely to maintain Platform integrity, unless deleted upon request

Deletion and De-identification:

After the applicable retention period expires, we will either:

  • Permanently delete your personal information from our systems, or
  • De-identify the information so it can no longer be associated with you

Even after deletion, some information may remain in backup systems for a limited period but will not be accessible for regular business operations.

If you request deletion of your account or personal information, we will honor your request subject to any legal or regulatory obligations to retain certain information.

You have the following rights as regard to use of your information and interaction with SabiWay:

  • Right to Opt Out of Promotional Communication. You may opt-out of receiving promotional updates via email, SMS, and push notifications, on the site and app, by visiting the "Notifications" page in your Account Settings and setting your choices.
  • Right to Correct. You have the choice to edit and rectify inaccuracies in your account at any moment by checking in and selecting the "Account" option. You can access, edit, and correct your account information.
  • Right to Delete. You have the option to request that the personal information we presently have about you be deleted. Please be aware, however, that in spite of your request, we might be required by law to keep such Personal Information.
  • Right to Know. You have the right to request and know the following about your Personal Information:
    • The category of personal information that we have collected about you
    • The sources that were used to collect the personal data
    • The categories of third parties that we shared your personal data with
    • The specific third parties that may have received your personal information

COMMUNICATION RECORDS

SabiWay facilitates communication between Customers and Service Professionals through our Platform.

In-Platform Messaging:

  • All messages sent through our Platform are stored on our servers
  • We may monitor communications to ensure compliance with our Terms of Service and to prevent fraud or abuse
  • Messages are retained for 1 year after service completion
  • We do not read your messages for marketing purposes

Customer Support Communications:

When you contact our customer support team, we collect and store:

  • Your inquiry and our responses
  • Any attachments you provide
  • Call recordings (if you contact us by phone)

This information is used to resolve your issue and improve our services. Support records are retained for 3 years.

Email Communications:

  • We may send promotional emails if you have opted in to receive them
  • All emails contain an unsubscribe link for marketing communications

  • Reviews are displayed publicly on Service Professional profiles
  • Reviews help other Customers make informed decisions
  • Reviews are used to maintain Service Professional quality standards
  • Aggregate rating data may be used for Platform analytics

Review Moderation:

We reserve the right to:

  • Remove reviews that violate our Community Guidelines
  • Investigate reports of fake or fraudulent reviews
  • Remove reviews that contain personal information, profanity, or discriminatory content

Your Rights:

  • Customers can edit or delete their reviews within 30 days of posting
  • Service Professionals can respond to reviews
  • Users can report inappropriate reviews for moderation

Review Retention:

Reviews are retained indefinitely to maintain Platform integrity unless:

  • The Customer requests deletion
  • The review violates our policies
  • The Service Professional's account is permanently removed

Public Profile Information:

Your Service Professional profile is publicly visible and may include:
